Terms & Conditions
I strive to provide you with excellent teaching and customer service. This document is a protocol for certain situations and helps to give you clarity and ensure the integrity of my services. Please read it in full and let me know if you have any questions before booking.
By booking anything with The Adaptive Yogi, you are agreeing to the following:
COMMUNICATION:
You will be contacted via the email you register with, so please keep that up to date online or with Jennie.
NEW STUDENT IN-PERSON REGISTRATION:
For the safety and protection of both student and teacher, all new students are required to complete a registration form prior to the start of the first session, including a health questionnaire and waiver of liability. Please complete this as accurately as possible, so I can deliver a safe and enjoyable session for you.
NEW STUDENT ONLINE REGISTRATION:
For the safety and protection of both student and teacher, all new students are required to complete a health questionnaire. The link to complete this form will be in your class booking confirmation email. Please complete this as accurately as possible, so I can deliver a safe and enjoyable session for you.
It is really important for online classes that you look after your own body and are fully aware that my instructions are a guide only. You choose what is right and safe for your body and mind to practice.
PAYMENT:
All classes must be pre-booked and paid for online, your booking and confirmed payment is non-refundable and reserves your space.
GROUP CLASSES IN-PERSON:
for Term Bookings:
By booking a term block of classes, you have a confirmed place in that class for the entirety of the term. If you are unable to make any of the term-booked classes, there is no facility to receive a refund.
*Your term booking conditions includes reverting to online if making in-person impossible for you*
For any of the above circumstances, you will be notified via the contact email entered on the booking system (so please keep it up to date!).
GROUP CLASSES ONLINE:
for Term Bookings:
By booking a term block of classes, you have a confirmed place in that class for the entirety of the term. If you are unable to make any of the term booked classes, there is no facility to receive a refund.
for Class Passes:
10 CLASS PASSES:
Your purchase of a 10 x class pass covers live classes ONLINE and confirmed payment is non-refundable and reserves your space. There is an expiry of 90days from when the first class is taken to use this concession pass. NO REFUNDS will be given for unused credit after the 90day period.
5 CLASS PASSES:
Your purchase of a 5 x class pass covers live classes ONLINE and confirmed payment is non-refundable and reserves your space. There is an expiry of 45days from when the first class is taken to use this concession pass. NO REFUNDS will be given for unused credit after the 45day period.'
for Memberships:
Your purchase of a membership commits you to monthly payments of your chosen membership. There are 40 weeks of live classes per year - THERE ARE NO LIVE CLASSES DURING THE NZ SCHOOL HOLIDAYS. You can cancel your membership at any time in your online student portal.
PRIVATE SESSIONS:
Payment:
All sessions must be paid for in advance and are non-refundable. Payment plans are negotiated on a case-by-case basis with Jennie Jackson. The Adaptive Yogi reserves the right to change fees.
Rescheduling:
You can change or cancel any booking up to 24 hours before the start time. By booking a session within 24 hours of the scheduled start time, you cannot change or cancel. If you cancel a private session within the 24 hour period or miss a private session, you will be charged in full, however, at Jennie Jackson’s discretion, this can be waivered if there was an ‘out of the ordinary’ situation and no one else wanting the same time slot.
Regular blocks:
If you purchase a block of privates, you accept that you are committing to scheduling the number of sessions purchased. Thereafter, changing or cancelling this slot, the above rescheduling rules apply.
Lateness:
Your session will start on time and finish at the scheduled time. If you are late, you forgo that time as part of your session.
EVENTS:
Event = ALL of The Adaptive Yogi Ltd workshops, multi-night retreats in NZ, day retreats, and courses, online or in person.
It is the customer’s responsibility to check the reservation of the event and ensure that the particulars contained are correct. Remembering and attending the event is the customer’s sole responsibility. The Adaptive Yogi will send reminders via email. Due to the possibility of messages being missed, it is the customer’s sole responsibility to keep their contact details up to date, check junk folders, mark The Adaptive Yogi as a safe sender in their inbox, and follow up with The Adaptive Yogi if they have not received any reminders prior to the event.
Payments & Cancellation:
Your non-refundable deposit secures you a spot on the event. If your plans change, it is possible to transfer your deposit (once only), incurring a deposit transfer fee, which will depend on the timing of your cancellation. Each event is different - see the specific dates in your welcome email for the event.
Additional Terms:
Due to situations beyond my control, The Adaptive Yogi reserves the right to change bookings and/or cancel the retreat and shall inform the customer as soon as possible. Alternative arrangements of equal value will be offered, or a full refund will be provided.
The customer shall keep all The Adaptive Yogi hired venues' property, fixtures, fittings, furniture, and effects in a clean and good working condition and shall replace any articles that are destroyed or missing with articles of a similar kind and of equal value.
The Adaptive Yogi retains all copyright license rights and sole exclusive ownership of the information, photographs, and material displayed on all online mediums. The material may not be modified, copied, or used in any other way.
The Adaptive Yogi cannot accept any responsibility for loss or damage of personal possessions or valuables, injury, or illnesses of the customer during their events.
In the event of a customer having any complaint, they must notify The Adaptive Yogi at the earliest opportunity, giving The Adaptive Yogi a reasonable chance to rectify the situation.
The Adaptive Yogi shall not be liable for any failures beyond its control. This includes natural disasters, war, closure of airports, civil strife, worldwide pandemics, accidents, or failure to perform by third parties, including suppliers and subcontractors.
Full detailed disclosure is required of any food allergies, the effects, and medical care required in the event of exposure.
You must notify, in writing during the process of booking (on your registration form), any medical conditions, pregnancy, disability, or any other mental and/or physical condition which may affect your participation in the retreat. You must have clearance from your doctor if you have any medical conditions before commencing any practices with The Adaptive Yogi. You must be comfortable and pain-free throughout all activities and remain within your personal limitations. If you experience pain or discomfort in any of the practices, stop and seek advice.
INTERNATIONAL (outside of NZ) MULTI-NIGHT RETREATS:
In addition to the standard event terms (above), the following payment and cancellation policies apply to international retreats (outside of New Zealand) due to the necessity of securing venues, paying deposits, covering marketing costs, and handling administrative tasks well in advance
Payments:
Non-refundable deposit upon booking (see above No 4.)
4 months before retreat: 50% of the balance owing is due
2 months before the retreat: Full payment of the balance owing is due.
Cancellation: I understand that unforeseen circumstances may arise, but this policy allows me to maintain the ability to offer these retreats at the most accessible price possible. If you cancel, for whatever reason….
4 months out from the retreat date: 50% of the retreat price paid is non-refundable, however, you will not be liable for the remaining balance.
2 months out from the retreat date: 100% of the retreat price paid is non-refundable.
Insurance: You must have your travel insurance to cover: flight/hotel cancellations, theft or loss of belongings, medical treatments during travel, if you are unable to attend/travel due to contracting Covid-19, if you are unable to attend/travel due to any other illness/accident or personal circumstance if the borders should get closed and you get stuck at the retreat venue.
FOR ALL OFFERINGS:
Jennie Jackson - The Adaptive Yogi holds the right to cancel/reschedule classes due to illness, being away, emergency, or unforeseen extraneous circumstances. Jennie Jackson holds the right to employ a cover teacher under these conditions, if a cover teacher cannot be found and the class is cancelled - you will receive a makeup opportunity or a credit towards the following term, if none of that suits, you can apply for a refund.
ADVICE: If you have noted any serious HEALTH conditions, you should check with your doctor for clearance and then fully inform Jennie Jackson with details and ask for guidance before commencing Yoga. You must be comfortable and pain-free throughout all activities, remain within your personal limitations. If you experience pain or discomfort in any of the practices, stop and seek advice. Should you suffer from any new injury, illness or condition in the future, please inform me ASAP.
WAIVER STATEMENT: I have disclosed my medical information to the best of my ability and understand the advice given above. I also understand that Jennie Jackson, cannot give medical advice and that the information I have given will be used as a guideline to the limitations of my ability for Jennies yoga classes. I understand that the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated. If I experience any pain or discomfort, I will listen to my body, adjust or change the posture, and inform and seek assistance. I know that yoga is not a substitute for medical attention, examination, diagnosis, or treatment. I also know that all suggestions made by Jennie Jackson are just suggestions and I am responsible for doing my own research and consulting a doctor before starting a yoga practice. I understand that yoga is not safe under certain medical conditions and take full responsibility for making the decision to practice yoga. I hereby agree to irrevocably release and waive any claims that I have now or hereafter may have against Jennie Jackson.
GENERAL GUIDELINES ON YOGA with THE ADAPTIVE YOGI:
Please:
Arrive a few minutes early to class/private session so that we can start the Yoga on time!
Stay until the end of the class, including final relaxation – Savasana, as this is the most important part of the practice where you absorb all the benefits.
Please refrain from checking your phone or smartwatch during class. If there are exceptional circumstances and you need to check your phone please let me know in advance. Otherwise, try to switch off! This is for your benefit and all others in the class.
I recommend you don’t eat 2 hours before class and make sure you are well hydrated.
Your health and wellbeing
Yoga is a safe and effective form of exercise, and I take great care to ensure your wellbeing. However, it is your responsibility to ensure the classes you take and the variations you choose are appropriate for your body. If you have any health concerns, it is your responsibility to discuss these with a healthcare professional before joining my classes.
When practicing online, please adapt in ways suitable for you, take breaks as you need, and practice in a safe space. Should you feel unwell or feel pain, stop immediately and seek advice from a medical professional. If in doubt about a pose or sequence, don’t do it.
By booking a class with me, you agree to honor your body by adjusting the practice to your own capabilities and needs to ensure that no personal injury occurs.
